Role and Responsibilities of Subnational Administration in Natural Resource Management and Environmental Protection

Background

Subnational administrations in Cambodia, comprising communes, quarters, towns, districts, and provinces, play a crucial role in managing natural resources at the local level. These areas include protected natural zones where environmental cleanliness, greenery, and sustainability are key focus areas. The Ministry of Environment collaborates with provincial authorities, local administrations, civil society organizations, partners, and local communities to strengthen law enforcement to prevent natural resource violations and protect forests, ensuring sustainable development.

Scope of Application

The roles and responsibilities apply specifically to the subnational administrative levels—communes, quarters, towns, districts, and provinces—that have designated protected natural areas within their geographical jurisdiction. This governance extends to environmental protection and natural resource management within these protected zones.

Key Provisions or Decisions

Recently, the Ministry of Interior confirmed and reinforced the mandated roles of subnational administrations in accordance with environmental and natural resource regulations, particularly emphasizing the management of protected natural areas within their geographical scope. The Deputy Prime Minister and Minister of Interior, Dr. Sar Sokha, issued a directive to the Governor of Preah Vihear province instructing the suspension and nullification of all landholding certificates within protected areas. Additionally, the construction of all forms of physical infrastructure in these protected zones must comply strictly with environmental regulations. Strengthening management, conservation, and protection of natural resources in protected areas is mandated in line with Ministry of Interior Letter No. 1222 dated April 11, 2024.

Minister Dr. Eang Sophal of the Ministry of Environment emphasized that subnational administrations’ participation in resolving environmental issues at the grassroots level, especially in promoting protection and conservation of natural resources, is a key indicator of effective policy implementation.

Previously, the Ministry of Environment reported to the Ministry of Interior concerning land occupation incidents within wildlife sanctuary areas, specifically in the Cheab Lech village of Cheab Muoy commune in Cheab district, Preah Vihear province.

Implications for Investors, Businesses, or Compliance

Investors, developers, and local businesses operating in or near protected natural areas must comply with strict environmental regulations and coordination with subnational authorities. No construction or landholding activities within these zones are permitted without adherence to these guidelines, which aim to ensure sustainable environmental management and resource conservation. Compliance with these directives is essential to align with national environmental policies and reduce risks related to unauthorized land use or infrastructure development within protected zones.
